Tier 1 Investor Visa Extensions and Indefinite Leave to Remain

Whilst it is no longer possible to apply for a new Tier 1 (Investor) visa, if you or your client already have one, or had one within the last 12 months and it was your most recent visa, then you may still apply for indefinite leave to remain in the UK; to extend your Investor visa for two years, or for family members to join you.

Extending your Investor visa

It may be possible to extend your Tier 1 (Investor) visa for two years, providing you do so before it expires. If you have family members who have joined you with their own visas, then they will need to apply separately to extend theirs, either at the same time as you, or any time before the expiry date of their current visas.

If you successfully applied for your visa before 6 November 2014, then you will be able to apply for an extension if you have had a minimum of £2 million invested in UK government bonds, share capital or loan capital in active UK companies since 6 April 2020; if you had a minimum of £1 million under your control in the UK prior to 6 April 2020, and if you invested £750,000 in UK government bonds, share capital or loan capital in active UK companies within three months of your ‘investor start date’.

If you successfully applied for your visa on or after 6 November 2014, then you will need to have a minimum of £2 million under your control in the UK; have invested those funds in share capital or loan capital in active UK companies, and invested this sum within three months of your ‘investor start date’.

If you successfully applied prior to 29 March 2019, then you can also apply to extend your visa if you invested your funds in UK government bonds.

Bringing family members to join you in the UK on an investor visa

Your dependants can join you if you’re currently in the UK on an Investor visa. A dependant is classed as a spouse or partner; a child under the age of 18, or a child over the age of 18 if they’re currently in the UK and classed as a dependant.

If you have children whilst you’re in the UK under this visa, you can apply to add them to your own visa as a dependant. If you wish to travel in and out of the UK with them, this is a mandatory step.

Applying for indefinite leave to remain

You may apply for indefinite leave to remain if you have a Tier 1 (Investor) visa. You will need to have lived in the UK for between two and five years, and meet the necessary financial requirements. These criteria will vary depending on when you successfully applied for your visa.
